TERMS OF SERVICE

1. Acceptance of Terms By accessing, browsing, or using the website verachadova. art (the "Site") and purchasing any products, you unconditionally agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are fully responsible for compliance with any local legislation. If you do not agree with any of these terms, you are prohibited from using or accessing this Site.
2. Eligibility & Guest Checkout User account registration is neither required nor available on the Site; all purchases are processed exclusively via guest checkout. To complete a transaction, the buyer must provide current, complete, and accurate purchase information (full name, email address, and physical shipping address). By placing an order, you confirm that you are at least the age of majority in your state, province, or country of residence and possess the legal capacity to enter into a binding contract.
3. Products, Pricing, and Modifications All descriptions of products and product pricing are subject to change at any time without notice, at the sole discretion of the artist. We reserve the right to modify or discontinue any artwork, print, or service at any time. Such changes will not affect orders that have already been accepted, paid for, and confirmed via email.
4. Customs, Duties, and Taxes For international orders, the buyer is solely responsible for the payment of any and all import duties, customs clearance fees, taxes, and brokerage fees levied by the destination country. The artist has no control over these charges, cannot predict their amount, and shall not be held liable or responsible for any such additional costs or related customs delays.
5. Limitation of Liability To the maximum extent permitted by applicable law, Vera Chadova shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from: the use or inability to use the Site; technical issues, interruptions, or downtimes caused by third-party hosting platforms (Tilda) or payment processing systems (Unipay); or delivery delays caused by postal services, couriers, or customs procedures. Furthermore, due to inherent differences in digital displays, monitor settings, and color calibration, minor variations in color representation between the digital images on the Site and physical prints or artworks may occur; the artist is not liable for such minor discrepancies.
6. Governing Law & Jurisdiction These Terms of Service and any separate agreements whereby we provide you goods or services shall be governed by and construed in accordance with the laws of Georgia. Any dispute, controversy, or claim arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts in Tbilisi, Georgia.
7. Changes to Terms We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for updates. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those revisions.

INTELLECTUAL PROPERTY & COPYRIGHT

1. Ownership of Artworks: All content, images, digital prints, graphics, and original works of art presented on the verachadova. art website are the exclusive intellectual property of the artist, Vera Chadova, and are protected by international copyright laws.
2. Personal Use Only: The purchase of any physical print or original painting grants the buyer a nonexclusive, non-transferable license solely for personal, non-commercial use and collection. The sale of an artwork does not transfer any copyright, reproduction (duplication) rights, or commercial distribution rights to the buyer. You shall not reproduce, duplicate, copy, resell, create merchandise based on the artworks, or use any work of art for commercial purposes, advertising, or promotion without the express written permission of the artist.
3. Usage of Website Content: We authorize the copying, digital reproduction, and publication of artwork images from this Site strictly for non-commercial purposes (such as personal blogs, art reviews, or aesthetic compilations), subject to mandatory attribution of the artist (Vera Chadova) and the inclusion of a direct, active hyperlink to verachadova.art.

ORDER FULFILLMENT & SHIPPING TERMS

1. Order Confirmation: Immediately following a successful payment transaction, the buyer will automatically receive an electronic notification via email confirming that their order has been received and processed.
2. Pre-Order & Production Timeframes: Please note that all prints available on the Site are manufactured on a pre-order basis. The process of production, preparation, and packaging of the goods prior to dispatch takes up to 10 business days.
3. Delivery Timeframes: Delivery is carried out by transport and courier services. Delivery typically takes approximately 14 business days (2 weeks) from the date of dispatch, depending on the destination country and customs procedures. A tracking number for parcel tracking purposes will be sent to your email address immediately upon dispatch of the order. Shipping Address
4. Corrections: If you detect an error in the shipping address specified during checkout, you must notify us via email at art@verachadova.art within 7 calendar days from the date of placement of the order. We do not guarantee the possibility of amending the address upon the expiration of this 7-day period or in the event that the order has already been dispatched.

RETURN & REFUND POLICY

1. General Return Conditions: You have the right to return any item (original paintings or prints) purchased on the verachadova. art website within 14 calendar days from the date of its physical receipt. To be eligible for a return, the item must be returned in the same condition that you received it, with no signs of use, and in its original packaging.
2. Return Shipping Costs: All expenses for return transportation and delivery of items of good quality (if you simply changed your mind or the item did not suit you) are fully paid by the customer. Original shipping costs are non-refundable.
3. Actions Upon Receiving Damaged Goods: We pay special attention to the security and reliability of our packaging. However, if your parcel arrives damaged during transit, you must send photos of the damaged outer packaging (box/tube) and the painting or print itself to our email address: art@verachadova.art within 24−48 hours of physical receipt. Please include the buyer’s full name and order number. Claims submitted later than 48 hours after delivery will not be considered.
4. Conditions for Reshipping or Compensation: Reshipping the item or issuing a financial refund is only possible on the condition that the customer sends the damaged item back to the artist. Reshipping or refunding will be processed exclusively after the damaged item has been physically received and inspected by the artist.
5. Refund Process: Once your returned item is received and inspected, we will send you an email notification. We will also notify you of the approval or rejection of your refund. If approved, your refund will be automatically processed and applied to your credit card or original method of payment within 7- 10 business days.

We use the following services: Tilda — the platform hosting our online store. Google Sheets — for secure internal order tracking and records. MailerLite — for technical delivery of emails related to your order. Unipay — for secure processing of your payments. (We do not have access to your full credit or debit card details). Postal and courier services — for the physical delivery of paintings and prints to your address.
6. Data Retention When you place an order through the Site, we retain your order information for our records indefinitely. This is necessary for maintaining sales history, internal statistics, and addressing any potential administrative or customer service inquiries in the future.
